Terms and Conditions

1. Products - General


1.1 All products on this website are only available for delivery to postal areas, WV1, WV2, WV3, WV4, WV5, WV6, WV7, WV8, WV9, WV10, WV11, WV12, WV13, WV14, DY3 and DY4. They are not available for National/International delivery.
1.2 We reserve the right to change all or some of the contents or packaging for all requested floral products and gifts to provide an item of equal or greater value without notice. All products are subject to availability.
1.3 Products may be delivered in bud to ensure longer life.
1.4 Some products, flowers and plants may be harmful or poisonous. If you require further information before submitting an order please contact us.
 

Products - Sizes

1.5 All sizes quoted for funeral tributes are approximate.
1.6 Where standard, medium, large and deluxe options are offered all images are of the medium size option with the exception of our single/six and dozen long stemmed rose options where the images are of the standard size option.
1.7 Choosing the standard size option would mean there would be fewer flowers than illustrated. Choosing the large or deluxe option gives us more flexibility and value to fill your order. This difference can be made by a combination of a greater quantity of flowers, a greater variety of flowers, a better quality grade of flowers and greater quality accessories and packaging.

2. Delivery - Availability

2.1 We personally only deliver to postal areas, WV1 through to WV14, DY3 and DY4. If you place an order for outside our delivery range we will either have to reject your order via email and refund your payment or if possible pass your order to a Flowers Direct member florist in the relevant postal area.
2.2 Only products marked same day are available for same day delivery and we must receive your order form by 1 p.m. (GMT) Monday - Friday and 12 p.m. (GMT) Saturday.
2.3 Items marked next day are available for next day delivery if your order form in received by us before 3 p.m. (GMT) on the day before your requested delivery date, or before 3 p.m. (GMT) on Saturday for Monday delivery.
2.4 Items marked two day delivery are available for delivery two working days after your order is placed if your order form is received by us before 3 p.m. (GMT) or before 3 p.m. (GMT) on Friday for Monday delivery.
2.5 Different cut off times will apply at peak periods, such as Valentine’s Day, Mother’s Day and Christmas. All relevant cut off dates for these periods will be posted clearly on the site.

3. Delivery - General


3.1 No deliveries are made on Bank Holidays or Sundays (Mother’s Day and Valentine’s Day being the only exceptions).
3.2 Orders received for delivery on Sundays or Bank Holidays will either be rejected and refunded or executed on the next working day.
3.3 Deliveries may also not be available on certain dates throughout the year, such as over the Christmas period. Any unavailable delivery dates will be posted on this site at least two weeks in advance of the relevant dates. Any orders for these dates will be rejected and refunded.

Delivery - Times & Practices

3.4 The AM/PM preference is just that - a preference. We do not guarantee delivery times unless the order is for a funeral, in which case delivery will be made usually 1-2 hours in advance of the funeral time. We always try to adhere to your preference wherever possible.
3.5 No preferences can be taken into account on Valentine’s Day or Mother’s Day weekend.
3.6. We do not accept time slots i.e. between 12 p.m. - 1 p.m. or stated times i.e. at 10 o’clock. When placing your order you are able to specify further delivery information. This field is intended to provide further guidance for delivery purposes such as hospital ward numbers etc, not to specify delivery times. We reserve the right not to action any delivery request specified which we deem unacceptable.
3.7 We deliver all non funeral orders between 9 a.m. and 5 p.m., during busy periods this may be extended to 6.30 p.m. However school and business opening hours are taken into account if noted when scheduling deliveries.
3.8 Where we are unable to find someone to accept delivery we will either deliver to a neighbour or leave a card at the address for the recipient to make contact.
3.9. In the instance of there being difficulties in delivering your order we reserve the right to contact the recipient using the contact details provided on the order form.
3.10 In the case of certain locations where a third party is involved such as offices, hospitals, funeral directors and hotels the signature of any person authorised to accept delivery on behalf of that organisation shall be accepted as proof of delivery to your chosen recipient
3.11 In very exceptional circumstances delivery on the requested terms will not be possible. In such circumstances you will be given prior notice whenever possible and we shall make alternative arrangements to ensure delivery is achieved or provide a refund of the item price and delivery if applicable.

Delivery - Charges

3.12 Our standard delivery charge is £2.95 for all deliveries. This will be added to your order value for each delivery requested. If you are ordering more than one item to be delivered on the same day to the same address only one delivery charge will be made.
 

Orders & Payments

4.1 We accept payment by all major credit and debit cards including Mastercard, Visa, Visa Electron, Solo & Eurocard Mastercard. Sorry, we do not accept Amex, Diners Club or American Express.
4.2 Submitting your order form is subject to our acceptance of this offer. Once your order is received we will either issue a written confirmation of acceptance by email confirming your total order value and order details or in exceptional circumstances reject your order and refund your payment if we are unable to fulfil it or if delivery times or dates are deemed unacceptable to us. The email shall be directed to the email address you supply to us on order placement.
4.3 We will not consider ourselves bound by contract with you until we have issued confirmation of acceptance of your order.
4.4 All order confirmations or rejections will normally be sent during the hours of 8 a.m. - 6 p.m. (GMT) Monday - Saturday.
4.5 In order for us to deliver your requested gifts on the specified date we require complete and accurate details of the recipient including a recognisable recipient name, address, postcode and contact telephone number (s) for the recipient. In addition we need your daytime contact telephone number in case of delivery problems.
4.6 We cannot accept responsibility for problems and/or delays caused due to inaccurate or incomplete information.
4.7 Before placing your order please review delivery cut off times and prices accessed from the product details page of each product.

Cancellation

5.1 With the exception of funeral tributes all orders may be cancelled up until 12 p.m. (GMT) on the day prior to delivery date (Saturday if delivery date is Monday). Please telephone us to request a cancellation on

5.2 Next day funeral tributes may be cancelled up until 12 p.m. (GMT) two working days prior to delivery date (Friday if delivery date is Monday).
5.3 Two day funeral tributes may be cancelled up until 12 p.m. (GMT) three working days prior to delivery date (Thursday if delivery date is Monday).
5.4 Where the customer exercises their right to cancel we will return their money to their account within 30 days of cancellation.

Refund Policy

Ordinarily we'll refund the original debit, credit or charge card used to purchase the goods.
 

5.5 Refunds may occasionally be given at the discretion of the mangement.                                                                                                                       5.6 The Distance Selling Regulations, which entitle a customer buying online or over the phone to a full refund if requested in writing within 7 days of receipt do not apply to perishable goods such as flowers and chocolates.
5.7 This does not affect your statutory rights.

Data Protection

6.1 We shall ensure that we comply within the requirements of all current data protection legislation including without limitation, the Data Protection Act 1998. We shall only use personal information received from you for the purposes of fulfilling your order.

Security

7.1 We take online security very seriously, all orders are fully secure using a VeriSign Secure Site Certificate.

Statutory Rights

8.1 We are fully committed to providing you with the best possible service. If you are not satisfied in any way with the service please let us know and your complaint will be investigated.
8.2 Because of the perishable nature of our products we advise that you make any complaint within 3 working days but must be made within 7 working days of the date of delivery or intended date of delivery.
8.3 If we are satisfied that your complaint is genuine a suitable replacement or refund may be given. This does not affect your statutory rights as a consumer.

Disclaimer

9.1 Whist we agree to use our reasonable endeavours to ensure that the Wolverhampton Florists website and sales department is fully operational and error-free, we cannot guarantee that this will always be the case. We therefore accept no responsibility or liability for any defects or interruption of our service.
9.2 We shall be released from our obligations under these Terms and Conditions in light of any event beyond our reasonable control (i.e. acts of God, civil commotion, riot, flood, fire, drought) which renders the provision of our site and/or service impossible or impractical.
9.3 We exclude all liability for claims, losses, demands and damages, including without limitation, any costs, loss of profit, loss of contracts or business opportunity, loss of data and any other consequential, incidental, special or punitive damages, even if we have been advised of the possibility of such damages, arising directly or indirectly out of or in any way connected with your use or inability to access the Wolverhampton Florists website and/or service, whether arising in contract, tort (including negligence), under statute or otherwise provided that nothing contained in these Terms and Conditions affects or will affect you or the recipient’s statutory rights in relation to the quality, fitness or description of the Wolverhampton Florists products supplied.

General

10.1 By clicking the ‘Submit’ button on the Delivery Information Form you are consenting to be bound by our Terms & Conditions.
10.2 We reserve the right to supplement and amend the Terms and Conditions on which you are permitted to access the Wolverhampton Florists site and/or service from time to time. It is your responsibility as the customer to check the terms and conditions every time you place an order.
10.3 Your purchase will be deemed to have occurred in the UK. These Terms and Conditions shall be governed by and construed in accordance with English Law and the parties agree to submit to the exclusive jurisdiction of the English Courts.
